Article 1. Tasks of the Criminal Procedure Code

The Criminal Procedure Code provides for the order and procedures for prosecution, investigation, prosecution, trial and enforcement of criminal sentences; the functions, tasks, powers and relationship between procedure-conducting agencies; duties, powers and responsibilities of procedure-conducting persons; rights and obligations of procedure participants, agencies, organizations and citizens; international cooperation in criminal proceedings in order to proactively prevent and stop crimes, accurately and quickly detect and handle all criminal acts in a timely manner, not to let criminals fall injustice innocent people.

The Criminal Procedure Code contributes to the protection of the socialist regime, the interests of the State, the legitimate rights and interests of citizens and organizations, and the protection of the socialist legal order. At the time of educating, everyone was aware of obeying the law, fighting to prevent and fight crime.

Article 2. Effect of the Criminal Procedure Code

All criminal proceedings in the territory of the Socialist Republic of Vietnam must be conducted in accordance with this Code.

Carrying out criminal proceedings against foreigners committing crimes in the territory of the Socialist Republic of Vietnam who are citizens of a member country of a treaty to which the Socialist Republic of Vietnam has signed or accession is conducted in accordance with the provisions of that international treaty.

For foreigners committing crimes in the territory of the Socialist Republic of Vietnam, which are entitled to diplomatic privileges or consular privileges or immunities under Vietnamese law, under national treaties. The case which the Socialist Republic of Vietnam has signed or acceded to or according to international practice, the case shall be settled through diplomatic channels.
