Article 78. Crime of betraying the Fatherland
1. Vietnamese citizens who collude with foreign countries in order to harm the independence, sovereignty, unity and territorial integrity of the Fatherland, the defense forces, the socialist regime and the State of the Republic Vietnamese socialist shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or capital punishment.
2. Committing the crime in cases involving many extenuating circumstances, the offenders shall be sentenced to between seven and fifteen years of imprisonment.
Article 79. Crime of carrying out activities aimed at overthrowing the people’s administration
Those who operate to establish or join an organization aiming to overthrow the people’s administration shall be fined as follows:
1. The organizer, the instigator, the person who acts effectively or causes serious consequences, shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or the death penalty;
2. Other accomplices shall be sentenced to between five and fifteen years of imprisonment.
Article 80. Crime of espionage
1. Those who commit one of the following acts shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or capital punishment:
A) Intelligence activities, sabotaging or creating grounds for intelligence activities, sabotage against the Socialist Republic of Vietnam;
B) Establishing grounds for intelligence or sabotage activities under the direction of foreign countries; detecting, pointing, harboring, navigating or performing other acts to help foreigners conduct intelligence and sabotage activities;
C) Supplying or collecting for the purpose of supplying State secrets to foreign countries; collect and supply other information and documents for foreign use against the Socialist Republic of Vietnam.
2. In the case of committing less serious crimes, the offenders shall be sentenced to between five and fifteen years of imprisonment.
3. Persons who have accepted to act as spies, but fail to perform their assigned tasks and confess and sincerely report to competent State bodies, shall be exempt from penal liability.
Article 81. Crime of infringing upon territorial security
Those who enter the territory, act to falsify national borders or take other actions aimed at harming the territorial security of the Socialist Republic of Vietnam, shall be sanctioned as follows:
1. Organizers or persons who operate effectively or cause serious consequences shall be sentenced to between twelve and twenty years of imprisonment or life imprisonment;
2. Other accomplices shall be sentenced to between five and fifteen years of imprisonment.
Article 82. Crime of riot
Those who engage in armed activities or use organized violence to oppose the people’s administration shall be fined as follows:
1. Organizers or persons who operate effectively or cause serious consequences shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or death;
2. Other accomplices shall be sentenced to between five and fifteen years of imprisonment.
Article 83. Crime of libel activities
Those who aim to oppose the people’s administration but conduct armed activities in mountainous areas, seas or other critical areas, kill people or loot property, shall be sanctioned as follows:
1. Organizers or persons who operate effectively or cause serious consequences shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or death;
2. Other accomplices shall be sentenced to between five and fifteen years of imprisonment.
Article 84. Crime of terrorism
1. Those who aim to fight against the people’s administration but infringe upon the lives of cadres, civil servants or citizens shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or the death penalty.
2. Committing the crime in the case of infringing upon the freedom of the body or health, the offenders shall be sentenced to between five and fifteen years of imprisonment.
3. Committing the crime in cases where life is threatened or commits other acts of intimidation, the offenders shall be sentenced to between two and seven years of imprisonment.
4. The terror of foreigners in order to cause difficulties to the international relations of the Socialist Republic of Vietnam shall be also sanctioned according to this Article.
Article 85. Crime of damaging material and technical foundations of the Socialist Republic of Vietnam
1. Those who aim to oppose the people’s administration but destroy the material and technical foundations of the Socialist Republic of Vietnam in the fields of politics, security, defense, economics, science – technology arts, culture, society, offenders shall be sentenced to between twelve and twenty years of imprisonment, life imprisonment or death.
2. In the case of committing less serious crimes, the offenders shall be sentenced to between five and fifteen years of imprisonment.
Article 86. Crime of undermining the implementation of socio-economic policies
1. Those who aim to oppose the people’s administration but undermine the implementation of socio-economic policies shall be sentenced to between seven and twenty years of imprisonment.
2. In the case of committing less serious crimes, the offenders shall be sentenced to between three and seven years of imprisonment.
Article 87. Crime of undermining solidarity policy
1. Those who commit one of the following acts against the people’s administration shall be sentenced to between five and fifteen years of imprisonment:
A) Causing divisions between classes of the people, between the people and the armed forces, with the people’s administration, and social organizations;
B) Causing hatred, discrimination, ethnic division, and infringement of equal rights in the community of ethnic groups
C) Dividing religious people with non-religious people, separating religious believers from the people’s administration or social organizations;
D) Undermining the implementation of a policy of international solidarity.
2. In the case of committing less serious crimes, the offenders shall be sentenced to between two and seven years of imprisonment.
Article 88. Crime of conducting propaganda against the State of the Socialist Republic of Vietnam
1. Those who commit one of the following acts against the State of the Socialist Republic of Vietnam shall be sentenced to between three and twelve years of imprisonment:
A) Propagating, distorting or defaming the people’s administration;
B) Propagating psychological warfare and spreading fabricated news to cause confusion among the people;
C) Making, storing and circulating documents and cultural products with anti-State contents against the State of the Socialist Republic of Vietnam.
2. In the case of committing particularly serious crimes, the offenders shall be sentenced to between ten and twenty years of imprisonment.
Article 89. Crime of disrupting security
1. Those who aim to fight against the people’s administration but incite, entice or gather many people to disrupt security, oppose public service executors, obstruct activities of agencies or organizations, if not falling into the category of defined in Article 82 of this Code, the offenders shall be sentenced to between five and fifteen years of imprisonment.
2. Other accomplices shall be sentenced to between two and seven years of imprisonment.
Article 90. Crime of fighting against detention centers
1. Those who aim to oppose the people’s administration but destroy prisons, organize escapes from prisons, beat up detainees, escorts or escape from prisons, shall be sentenced to between ten and twenty years of imprisonment or joint imprisonment. Dear.
2. In the case of committing less serious crimes, the offenders shall be sentenced to between three and ten years of imprisonment.
Article 91. Crime of fleeing abroad or staying abroad in order to oppose the people’s administration
1. Those who flee abroad or stay abroad in order to oppose the people’s administration shall be sentenced to between three and twelve years of imprisonment.
2. Organizers, coercors and solicitors shall be sentenced to between five and fifteen years of imprisonment.
3. In the case of committing particularly serious crimes, the offenders shall be sentenced to between twelve and twenty years of imprisonment or life imprisonment.
Article 92. Additional penalties
Offenders defined in this Chapter may also be deprived of certain citizenship for one to five years, probation, ban from residence for one to five years, and confiscate part or all of their property.
